In an Order dated June 2, 2015, the Honorable Gregory Chelak granted the Commonwealth's Request to Seal Exhibit #1 Offered into Evidence at the Preliminary Hearing. Judge Chelak ruled that the decision to seal the video is one means of ensuring the victims and their families, as well as the PSP and law enforcement officials, are not subjected to further trauma or risk to safety, beyond that already sustained. Judge Chelak also ruled that the release of the subject video to the public, even if intended to be viewed for information purposes only by some, would unquestionably and inevitably lead to exposure to radical individuals and groups. The evidence and testimony presented at the hearing on the Commonwealth's Motion constituted compelling reason to grant the sealing of the Exhibit.
